In a judgment handed down today, Mr Justice Meade ordered the expedition of a RAND trial for two claims between Warner Bros and Paramount against Nokia, relating to the licensing of Nokia’s Video Codec Standard Essential Patents (“SEPs”)

The dispute arises in the context of Nokia seeking injunctions in a number of jurisdictions, which will jeopardise the claimants’ businesses. The parties’ disputes relate to video coding patents declared essential by reference to the H.264 (AVC) and H.265 (HEVC) standards in the Recommendations of the International Telecommunications Union Standardisation Sector (“ITU-T”).

The Court considered the applications in light of the well-established principles in Gore v Geox ([2008] EWCA Civ 622) and concluded that it was appropriate to expedite a 15-day trial to the earliest possible time in the Michaelmas term of this year.
