The High Court has held that a decision to withdraw an honour is justiciable.
Decisions bestowing or withdrawing honours had at one time been considered to be non-justiciable and not subject to judicial review. That position is no longer the law, as Mrs Justice Leiven held in this ground-breaking case in a judgment derived on 6 October. The case concerns the withdrawal of a CBE from Lord Ranger.
Tom Hickman KC acted for the Claimant, leading Barney McCay (Matrix Chambers), instructed by Patron Law.
The judgment can be found here.
