On 13 February 2026, the Divisional Court handed down judgment on the Claimant’s challenge to the Home Secretary’s decision to add Palestine Action to the list of proscribed organisations at Schedule 2 to the Terrorism Act 2000.
The Court held that the decision was unlawful, on the basis that: (i) it gave rise to a disproportionate interference with the rights to freedom of expression and association under Articles 10 and 11 ECHR, and (ii) was made in breach of the Secretary of State’s policy.
