Limits of Duomatic Defence tested

In a summary judgment application on behalf of a large pharmaceutical company, the Commercial Court (Mr Justice Knowles CBE) considered the limits of the defence in Re: Duomatic to claims of breach of fiduciary duty, and also the principles of causation applicable to claims involving misappropriation of company assets by the 100% owners of that company.
