The General Medical Council (GMC) has scored an important victory protecting its decisions from excessive interference by the High Court. On 15th January 2007, the Court of Appeal reversed the decision of Mr Justice Collins in the cases of Fatnani and Rashid that set out guidelines determining when the High Court could interfere with sanctions imposed by the GMC. In overturning Collins J, the Court of Appeal has reaffirmed the principle established in guidelines from the Privy Council, that the court should be very slow to interfere with GMC-imposed sanctions. Robert Englehart QC and Ivan Hare, of Blackstone Chambers, acted for the General Medical Council.
